Executive Summary

Roche will pay Chiron $78 mil. to settle a dispute related to the firms' 2000 and 2001 HIV licensing agreements and alleged infringement of Chiron's '276 patent for HIV nucleic acid testing. The patent was issued in March 2003. The settlement covers clinical diagnostics and blood screening. The up-front payment is in lieu of Roche royalties beyond Jan. 1, 2005; Roche could later elect a partial refund in favor of ongoing royalties of 11%-19%...
