The company initiated the lawsuit against TVS in 2004. Diomed (Andover, Massachusetts) filed for injunctive relief and damages in the US federal district court for the district of Massachusetts with Judge Nathaniel Gorton, who previously ruled in the company's favour over injunctions against Vascular Solutions and AngioDynamics concerning the same patent (see Clinica No 1263, p 13).
