NLEA LAWSUIT AGAINST FDA ALLEGING FIRST, FIFTH AMENDMENT RIGHTS VIOLATION was filed in Utah federal court on May 16 by the National Council for Improved Health (NCIH), supplement marketer Stanley Malstrom, physician Michael Janson, biochemist and nutritional consultant Oscar Rasmussen, and consumer Clive Buchanan. The lawsuit is the latest in a series of suits charging that the Jan. 4 health claims regulations that FDA drafted pursuant to the Nutrition Labeling & Education Act are unconstitutional; to date, at least three other suits have been brought against FDA in federal courts in Colorado, California and the District of Columbia ("The Tan Sheet" May 9, p. 13).
